Overview of Presentation:

The presentation will address income and transfer tax issues that arise when there is litigation involving a trust or estate, and how tax impact can affect, or even promote, settlement. 

Speaker Bio:

Rebecca Wallenfelsz is a partner in the Chicago office of Chapman and Cutler LLP, in the Trust and Estate Department.  Ms. Wallenfelsz has extensive experience representing individuals and institutions in estate planning and trust and estate matters.  Ms. Wallenfelsz represents a variety of fiduciaries and beneficiaries in the administration of estates and trusts, including addressing fiduciary risk issues, tax issues and litigation matters, such as will and trust construction, breach of fiduciary duty and contested probate matters.  On the estate planning side, Ms. Wallenfelsz’s experience includes drafting a variety of wills, trusts and premarital agreements, and in planning for and minimizing transfer taxes and related income taxes, including taxes related to retirement plan assets.  

Ms. Wallenfelsz is an active speaker and writer for the IICLE, the ABA Real Property, Trust and Estate Section, the Chicago Bar Association and other organizations.  She is a member of American College of Trust and Estate Counsel and the current vice chair of the Probate and Fiduciary Litigation Group of the ABA Section of Real Property, Trust & Estate.  Ms. Wallenfelsz is a past chair and executive committee member of the Chicago Bar Association Trust Law Committee and Estate and Gift Tax Division of the Federal Tax Committee.  In 2011, Ms. Wallenfelsz was named to the Law Bulletin Publishing Company’s “40 Illinois Attorneys Under Forty to Watch” list of outstanding lawyers. 

Ms. Wallenfelsz earned her J.D., cum laude, from Loyola University Chicago School of Law in 1997, where she was Lead Articles Editor for the Loyola Law Journal and Articles Editor for the Administrative Law Judges Journal.  She received a B.A., cum laude, in the Program of Liberal Studies from the University of Notre Dame in 1994.
